# False Self-Employment in Germany: What Clients Risk

> False self-employment (Scheinselbstständigkeit) means a freelancer is self-employed on paper but in practice follows your instructions and works as part of your organisation. German law then treats you as the employer, and you owe social security contributions retroactively, usually for four years or more. The German pension insurance (DRV) issues binding status rulings free of charge.

Plenty of foreign companies hire German freelancers the way they would hire contractors at home: a contract, monthly invoices, a Slack account, done. The German pension insurance does not care what the contract is called. It looks at who decides what the person does each morning.

Germany has a word for getting this wrong, Scheinselbstständigkeit, usually translated as false or bogus self-employment. The idea resembles the UK's IR35 rules or worker misclassification in the US. The difference is who pays: in Germany the bill lands almost entirely on the client, and there is no exemption for small companies.

## What German law actually tests

The rule sits in [§ 7(1) SGB IV](https://www.gesetze-im-internet.de/sgb_4/__7.html), the German social security code. Employment is non-self-employed work, and the two statutory pointers are working under instructions and being integrated into the work organisation of whoever gives those instructions. That is the whole text. Everything else comes from an overall assessment of the circumstances, so no checklist can give you a guaranteed answer.

The courts have built up a set of indicators over the years. None decides a case alone.

**Indicators the German pension insurance weighs against each other**

| | points to employment | points to self-employment |
|---|---|---|
| Hours and place | fixed core hours, office attendance | sets own schedule, own workspace |
| Tasks | tickets assigned as they come | defined deliverable with acceptance |
| Equipment | company laptop and email address | own hardware and licences |
| Organisation | in the org chart and team rituals | single point of contact, no team role |
| Business risk | paid for time present | fixed price, liable for defects |
| Market presence | one client for years | several clients, own website |
| Substitution | must do the work personally | may send a subcontractor |

Pay matters too. Germany's Federal Social Court ruled on 31 March 2017 (B 12 R 7/15 R) that the fee level is a weighty indicator: if it is well above what a comparable employee earns and leaves room for private pension provision, that points towards genuine self-employment. Our page on [freelancer hourly rates](https://freelancerbewertung.de/en/contracts/freelancer-hourly-rates/) shows what normal looks like. A good rate helps. It cannot rescue an arrangement that is otherwise a job.

How strict the courts can be became clear on 28 June 2022, when the same court classed a music school teacher on a long-running freelance contract as an employee (B 12 R 3/20 R). Schools and training providers were hit so hard that lawmakers added a transitional rule for teaching work running until the end of 2027 (§ 127 SGB IV). Developers, designers and marketers get no such grace period.

## Setups that go wrong most often

The classic case is the contractor who fills a vacant role. They get a company laptop, an address on your domain, a seat in the daily stand-up and the same Jira board as staff, and they stay for eighteen months. Organisationally they are indistinguishable from an employee. Legally, they then are one.

Remote work does not fix this. Someone in Leipzig who joins your 9:30 stand-up from home and picks tickets from your sprint is integrated just the same.

Agency and employer-of-record setups add a third party. Under § 7a(2) SGB IV the DRV can check whether the freelancer is really employed by the end client, so the risk does not automatically sit with the intermediary. Designers and copywriters who deliver a logo or a campaign from their own studio, for several clients, are usually on safer ground. Put the same designer in your marketing team three days a week, taking tasks from the team chat, and the picture changes.

## What a wrong call costs

If an audit finds employment, the client is the employer and owes the full social security contribution, employer and employee shares. Under § 28g SGB IV the employee share can only be recovered by deducting it from pay, and only from the next three payments. For past years the client effectively pays everything.

Claims become time-barred four years after the end of the calendar year in which they fell due, or after 30 years if contributions were withheld deliberately (§ 25 SGB IV). Late-payment surcharges of 1% per started month come on top (§ 24 SGB IV), unless you can show you were unaware of the obligation through no fault of your own.

**Example: back contributions for 24 months at €6,000 per month**

- Pension and unemployment, 21.2% of €6,000: €1,272.00
- Health, 17.5% of €5,812.50 (ceiling): €1,017.19
- Long-term care, 3.6% of €5,812.50: €209.25
- Contributions per month: €2,498.44
- **Back payment for 24 months: about €59,960**

Simplified. Excludes levies, accident insurance and surcharges. Health insurance top-up assumed at 2.9%.

Source: 2026 contribution ceilings published by the German federal government; statutory rates pension 18.6%, unemployment 2.6%, health 14.6%, long-term care 3.6%

Close to €60,000 for one contractor, and that is the mild version. Deliberate cases can also lead to criminal proceedings for withholding employee contributions under § 266a of the German Criminal Code.

## Getting a binding ruling from the DRV

The status determination procedure under [§ 7a SGB IV](https://www.gesetze-im-internet.de/sgb_4/__7a.html) is the only way to get a binding answer. The DRV's clearing office handles it. Either party can apply online with form V0027 or on paper. It is free, and the DRV puts the average processing time at about three months.

Three features make the difference:

1. **Ask before the project starts.** Since 2022 the DRV can rule in advance, based on the contract and how the work is planned (§ 7a(4a)). Material changes up to one month after the start must be reported.
2. **Apply within one month of the start.** If you do, any insurance obligation that is found starts only when the decision is announced, not retroactively (§ 7a(5)). The freelancer has to agree and must have had health and pension cover in the meantime.
3. **Reuse a decision.** After an individual ruling you can request an expert opinion that covers other contracts set up the same way (§ 7a(4b)). Useful if several freelancers work under one framework agreement.

Objections and court actions against a status decision suspend it. Keep one date in mind: the advance ruling, the expert opinion and the third-party review all expire on 30 June 2027 under § 7a(7), unless parliament extends them. If you want to use them, plan for projects that start before then.

## Structuring the work so it really is freelance

A clean contract is the foundation. Our list of [what to include in a freelance contract](https://freelancerbewertung.de/en/contracts/freelance-contract-clauses/) covers the paperwork. Day-to-day practice is what decides, though:

- Define outcomes, not hours: "checkout module with Stripe integration, accepted against a test plan" rather than "40 hours a week of backend work".
- No mandatory core hours or attendance. Scheduled check-ins are fine.
- The freelancer uses their own hardware. Access to your systems is normal, a company laptop is a warning sign.
- Keep them out of holiday planning, team events and the org chart.
- Pay per milestone or with fixed-price elements rather than per day present.
- Time-limit the engagement and do not let it roll over silently.
- Allow substitution or subcontracting in writing where it makes sense.

Some work simply does not fit. If you need someone long term who slots into a team and takes direction, you are looking for an employee, or for a provider that owns a whole package with its own staff, such as a studio like [OnlineBuilders](https://onlinebuilders.biz/solutions/software-development). Our comparison of [freelancer vs agency](https://freelancerbewertung.de/en/finding-freelancers/freelancer-vs-agency/) walks through that choice, and the [contracts section](https://freelancerbewertung.de/en/contracts/) has the rest of the legal ground.

Before the next contract goes out, run the DRV's anonymous online self-check on employment status. If the result is unclear, file a joint application for an advance ruling before day one.

## FAQ

### Does German contractor law apply if my company is outside Germany?

Usually yes, if the person works in Germany. German social security law follows the place of work (§ 3 SGB IV), and inside the EU the coordination rules point the same way. Being invoiced from Berlin by someone you manage from London does not move the job to London.

### Is a freelancer with one client automatically falsely self-employed?

No. The test is about instructions and integration, not the number of clients. A self-employed person who works mainly for one client long term and has no staff does have to pay into the German pension scheme personally under § 2 sentence 1 no. 9 SGB VI, but that is their obligation, not yours.

### How long does a status determination take?

The DRV says about three months on average. If nothing has been decided after three months, § 7a(6) SGB IV allows a court action for failure to act. Missing documents are the most common cause of delay.

### Can the freelancer apply on their own?

Yes. Either party may apply, and a joint application is usually smoother because the hearing step before the decision can be skipped. In agency setups the end client can be drawn into the review as a third party.
